This General Privacy Policy, our Terms of Use and our Privacy Notice for California Residents under the California Consumer Privacy Act of 2018 set forth the conditions under which you may access and use our Website. By accessing and using our Website, you agree to be bound by our said Privacy Notice and Terms of Use then in effect and by all applicable laws. If you do not agree with any of the Terms of Use or our Privacy Policy, you should not access or use our Website for any purpose.

California residents have more and different rights. For California residents, please see below “How to Contact Us”. In the event of a conflict and if you are a California resident, the terms of our said Privacy Notice for California Residents shall control over the terms herein.

We may terminate or limit your access to our Website for any violation of the Terms of Use or our Privacy Policy, or for any other reason, in our sole discretion.

The term “us” or “we” or “our” refers to Zojirushi America Corporation, its parent corporation, Zojirushi Corporation and our affiliated entities. The term “you” refers to the users of our Website.

We respect your privacy and are committed to protecting it. This Privacy Policy describes the types of information we may collect from you when you visit our Website, purchase our products, access our services, or otherwise interact with us. It also describes how we use and disclose the information we collect, how we protect information from unauthorized use or disclosure, and the choices you have regarding our collection and use of such information.

If you provide us with Personal Information (defined below), either through our Website, via phone, digital device or e-mail, we may collect and use that information to contact you or to send you additional information to process your purchase, provide service and support, and share product, service and company news and offerings, analyze transactions or purchase histories to improve our products, services, programs, and other offerings, evaluate your shopping experience, keep a record of our interactions with you, prevent, investigate, or provide notice of fraud, unlawful or criminal activity, or unauthorized access to our Website or data systems or unauthorized use of Personal Information, to meet legal obligations and to enforce our Terms of Use, our CCPA Policy and other agreements.

If you send us e-mail that includes Personal Information, normally we will use the information only to respond to your message and for no other purposes.

By visiting us, by providing solicited or unsolicited Personal Information to us, by enrolling in one of our customer programs, or through other means, you are consenting to our using your Personal Information, subject to applicable laws and you are agreeing to the terms of this Privacy Policy.

PERSONAL INFORMATION DEFINED

WE COLLECT INFORMATION AS FOLLOWS.
Many of our services require that you provide Personal Information when you sign up for an account with us, sign up for our programs, offers, or sweepstakes, take one of our surveys, purchase our products or services, contact us about a prior purchase, or email, call, or otherwise communicate with us. Similarly, if you contact us regarding a product or service that you are interested in or concerned about, we may request that you provide Personal Information that will enable us to respond to your inquiry. We may also collect and store limited payment information, such as payment card type and expiration date. However, we do not collect or store full payment card numbers for longer than one day and all transactions are processed by our third-party payment processor;
  3. Information About Others, such as the names and email addresses of gift recipients when you purchase gifts;
  4. Information we obtain from you using our services or buying our products. We may collect information about the products and services that you buy or view. When you shop online or register for or use any of our services, transactional and other information, such as the date of your purchase, or service usage, their descriptions and, if applicable, the dollar amount or value of the transaction, your Internet protocol address, browser type, domain names, access times, operating systems, mouse clicks and movements and scrolling activities may be collected automatically or “passively” by us or by one or more of our third-party service providers. We treat this information as Personal Information if we combine it with or link it to other information that specifically identifies you;
  5. Mobile Device Information. We may also collect mobile device information using beaconing technology, such as: the device type, model and operating system version, and current IP address. We do not use this technology to collect Personal Information. To disable our ability to identify your mobile device, you can adjust the in-app settings, or turn your Bluetooth to “off” on your device;
  6. Log information. When you use our services or view content we provide, we may automatically collect and store certain information in server logs. This may include:
    1. details of how you used our service, such as your search queries;
    2. telephony log information like your phone number, calling-party number, forwarding numbers, time and date of calls, duration of calls, SMS routing information and types of call;
    3. Internet protocol address;
    4. device event information such as crashes, system activity, hardware settings, browser type, browser language, the date and time of your request and referral URL; and
    5. cookies that may uniquely identify your browser or your account.

Data we collect about you. With regard to each of your visits to our Website we will automatically collect personally identifiable information about your visits through the use of various technologies, which includes information about your internet service provider, your device’s unique identifier, such as an IP address, browser type, operating system, pages accessed on our sites and online sources, and the date and time of access in order to optimize your user experience and enhance your time spent with us online. We also receive information telling us from which website you came to our Website. Our Website, apps (if any) and online services use cookies to distinguish you from other users. This helps us to provide you with a better experience and allows us to improve our Website and services. Text Messaging Services. If you use text messaging, you are consenting to receive text messages on your cell phone or other mobile device about our products, services, and/or programs which may be sent by automated means. Text messages will only be sent to the mobile phone number you used. We do not charge a fee for our text message programs and assume no responsibility for charges by your carrier when you sign up to receive text messages from us.

Other Information. We may obtain information about you from third parties such as demographic marketing information, address verification, or mailing list information and combine it with other Personal Information.

You may opt out of the aggregation and analysis of data collected about you on our website by Google Analytics by visiting https://tools.google.com/dlpage/gaoptout and downloading and installing the Google Analytics Opt-out Browser Add-on.

DISCLOSURE OF YOUR PERSONAL INFORMATION

CALIFORNIA'S SHINE THE LIGHT LAW
We do not share any of your Personal Information with third parties for direct marketing.

California Civil Code Section 1798.83, known as the “Shine the Light” law, permits our customers who are California residents to request and obtain from us a list of what Personal Information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. Requests may be made only once a year and are free of charge. Under Section 1798.83, we currently do not share any Personal Information with third parties for their direct marketing purposes.

In no event will the parties bring claims against one another under the laws of another jurisdiction. Said claim or dispute shall be filed and adjudicated only in the federal or state courts located in Los Angeles, CA.
